RETIRED LAWYER:     Before you go bashing lawyers, it is time I had my say.
        (The lawyer pool)        I have been a lawyer for 43 years, doing trial work.  If
                                             you know anything at all, you  know that trial work is the
                                             most nerve-wracking and tedious type of work you can
                                             do.  The more sincere you are in your work, the more nerve
                                             wracking and tedious it is.  A lawyer knows that he will ulti-
                                             mately be the blame a case is lost, or, if it is won, that the client
                                             and witnesses "did it all", and the lawyer was just there to
                                             "witness" the performance and "reap" the reward for someone
                                             else doing all the work..

                                             I have been  bashed, along with all other lawyers,during this
                                             same 43 years.  This is my Webb page so now it is my turn
                                             to speak in response to all the bashing I have received as well
                                             those lawyers not deserving of bashing!

                                             When you do mostly trial work, you deal most of the day
                                             with other lawyers.  In these dealings is where you learn
                                             which lawyers are good and which lawyers fit in the cate-
                                             gory "deserving to be bashed!"  I admit, the good ones
                                             are in the minority.  Nevertheless, they also receive the
                                             bashing.

                                             Now you must realize this.  When a lawyer has to deal with
                                             a lawyer who "deserves to be bashed",  there are reasons
                                             many times worse than the reasons you have to bash lawyers
                                             in general.  You may not have known that.
 
                                             There are lawyers that lie to everyone, especially their clients.
                                             They tell their clients there is no way in the world they can
                                             lose their case or the rewards will be great ...... usually greater
                                             than the law even allows.  They will extract a large fee for
                                             handling the case and  then deny they ever made such a
                                             statement or promise.  In the meantime, you ending up
                                             having to charge your own client this unecessary money the
                                             other lawyer is causing and can't do much about it.

                                             There are lawyers that  steal from their clients.  I know this but
                                             I can't communicate this to the other lawyer's client.  He would
                                             not believe me anyway, since I am on the "other side."  There is
                                                            no need to go through all the other things  that make lawyers
                                             objectionable because you already know some of them, but
                                             don't think for 2 seconds you know most of them.

                                             What you probably don't know about are the reasons one
                                             lawyer "dislikes" another lawyer and maybe even "hates" him.
                                             There are lawyers that set dates for hearing and don't notify
                                             you of the date for the hearing.  They certify you have been
                                             notified.  You naturally don't show up for the hearing because
                                             you don't know about it.  Again, naturally you lose the hear-
                                             ing, either losing the suit, losing a valuable right or position in
                                             the lawsuit and when you notify the other lawyer, he says he
                                             will check the file about the notice, "think about admitting
                                             the truth" and having the judgment or order set aside and
                                             you never hear from him; or when you have to file a motion
                                             to set it aside, the Judge looks at the motion like it is just
                                             another event that a lawyer did not check his mail, his court
                                             schedule or do what he was supposed to do.  Does this
                                             sound frustrating?  It is.  Then John Q. Public has to bash
                                             all lawyers.  He doesn't think about the weeding out process
                                             we go through to punish or remove from our midst those
                                             lawyers which should be punished or removed.
 
                                             Then there is the lawyer that sets a case for hearing at a time
                                             when you are going to be out of town on another case and
                                             you have notified everybody, by certified mail, of this event,
                                             and the lawyer sets the hearing on that date.  The same thing
                                             happens again.  Frustrating.....

                                             The point, in case you haven't gotten it by now, is there are
                                             better reasons for me not to like certain lawyers.  The reasons
                                             are stronger than your reasons why you don't like certain
                                             lawyers but blame all lawyers in general.  I know some lawyers
                                             that are so despictable, only a mother could love them
                                             and I sometimes would seriously doubt that!!!

     JOHN Q. PUBLIC:       Since the "public" has banded itself together to condemn all law-
        (The Client pool)         yers, because of their individual experiences, let's look at
                                             "John Q. Public", in view of my experiences with them.

                                             I have had many clients who lied to me, probably figuring
                                             I would never work hard enough if I was told the truth, and
                                             devastated their case and me when we were caught in the
                                             lie.  Naturally, everybody believed I knew the lie all the time.

                                             Then there's the clients that tell you the truth but insist that
                                             you tell the lie and stick to it.

                                             Then there is the general attitude that if you cheat a lawyer,
                                             get him in trouble or involved in some kind of scheme, then
                                             you deserve a feather in your cap because "you bagged
                                             a lawyer!!!!"

                                             Then there are members of the public, that after you have
                                             taken a case on a contingency, won the case and made a
                                             recovery, they run off with all of the recovery, including
                                             my share.

                                             Then there's the abused wife, that after you have placed
                                             her husband in jail, with an order that he is not to be re-
                                             leased until he has paid all the alimony, child support and
                                             attorney's fees, she gets all the money, leaves with her
                                             money, my money and the children, and goes to Califor-
                                             nia!

                                             Then there's the wife, whose husband is in the Army, takes
                                             his wife every week to Fort Sam Houston for prenatal care,
                                             and shortly before delivery, files suit for divorce, swears he
                                             doesn't know where his wife is and gets a divorce and stops
                                             her allotment, and then convinces her, by statement alone,
                                             that the stopping of her allotment is "legal", otherwise it
                                             would never be done.  After taking the case on a contingency,
                                             advancing costs, having a trial setting aside the divorce decree,
                                             paying for certified copies of the Order setting aside the divorce
                                             decree, and spending three months convincing the stupid Air
                                             Force authorities that she is entitled to her past several months
                                             of allotment, I am not surprised to see this woman walking on
                                             the main street of San Antonio in a wardrobe that would cost
                                             a small foretune.  When she sees me, she "wants to talk" and
                                             tells me that she "received all the money" and "spent it."  She
                                             honestly and sincerely is sorry but would do "anything" for me.

                                             I am not going to give you 43 years of experiences.  This is not
                                             the full scope of 43 years.  It is as disagreeable for me to tell
                                             you about these experiences as it is for you to hear about them.

                                                            So now you know, if you did not know before, why lawyers
                                             are so distrusting.  They were born like you were.  It is our
                                             experiences that make us distrusting.  You don't hear any jokes
                                             from us about John Q. Public (our client pool).  We could
                                             make plenty of jokes ..... much more than can be made about
                                             lawyers, and they would all be true.
 
                                                            You members of John Q. Public are hard to distinguish.  All of
                                             you look honest and truthful.  Some of you sure as heck
                                             aren't!  The lawyer's funniest trait?.  We all act alike ..............
                                             distrustful  ....... hateful  .......... totally without cause!  Did you
                                             ever wonder why we are so tolerant of all the bashing?  We
                                             have considered the source, few critics being without guilt.

                                             In 43 years, it is my opinion that JOHN Q. PUBLIC is di-
                                             vided into categories.  A certain percentage lie, steal and
                                             really need and use the services of a lawyer.  The remain-
                                             ing percentage joke and criticize and don't, in any way,
                                             intend to be consciously fair nor impartial.

                                                            It is with GREAT RELIEF that I am now retired and have
                                             been painlessly relieved of the public fairness and impartiality!
